Nebard Infotech (OPC) Private Limited is a digital agency based in India, offering services including but not limited to:

• Marketing strategy and execution
• Digital and performance marketing
• Website and mobile application development
• UI/UX design and branding
• Revenue optimization and growth consulting
• Data analytics and campaign tracking
• SEO, SEM, and content marketing

3. Client Responsibilities

Clients agree to:

• Provide accurate and timely information required to deliver services
• Respond to queries, feedback, or approvals within a reasonable time
• Supply any content, data, or assets necessary for the scope of work
• Comply with applicable laws and refrain from using our services for unlawful purposes
• Respect our intellectual property and licensing agreements

4. Intellectual Property

Unless stated otherwise in a specific contract:

• Clients retain ownership of their original content and data
• Custom code and designs developed specifically for the client may be transferred upon full payment
• Nebard Infotech (OPC) Private Limited retains the right to reuse general frameworks, components, or methodologies developed internally
• Third-party software and assets are subject to their respective licenses
• We may showcase completed work in our portfolio unless the client requests otherwise

5. Confidentiality

Nebard Infotech (OPC) Private Limited agrees to maintain the confidentiality of any proprietary or sensitive information shared during the course of a project. We will not disclose such information to third parties without prior written consent, unless required by law.

6. Limitation of Liability

In no event shall Nebard Infotech (OPC) Private Limited be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or goodwill, arising out of or in connection with the use of our services. Our liability is limited to the total fees paid by the client for the specific service rendered.

7. Termination

Either party may terminate the relationship at any time with written notice. Upon termination:

• Clients are responsible for payment for all work completed up to the termination date
• All project files and deliverables (as applicable) will be handed over upon settlement
• Both parties agree to return or destroy confidential information shared during the engagement

8. Governing Law

These terms and any disputes related to them shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts in Alipurduar, West Bengal, India.

9. Changes to Terms

Nebard Infotech (OPC) Private Limited reserves the right to update or modify these Terms and Conditions at any time. Any changes will be posted on this page with the updated date. Continued use of our services after changes are posted constitutes acceptance.
